ORDER
Upon consideration of Defendant Michael Yates’ Motion to Dismiss Plaintiff’s Amended
Complaint or, in the Alternative, for Summary Judgment, Plaintiff Office of Open Government’s
(“OOG”) Opposition to Defendant’s Motion to Dismiss Plaintiff’s Amended Complaint and
Cross-Motion for Summary Judgment, the Replies, and the record herein, it is this 5th day of
March, 2018, hereby
ORDERED that Plaintiff’s Cross-Motion for Summary Judgment is GRANTED IN
PARTAND DENIED IN PART for the reasons set forth in the Court’s Order dated September
27, 2017; and it is,
ORDERED that Defendant’s Motion to Dismiss Plaintiff’s Amended Complaint or, in
the Alternative, for Summary Judgment is GRANTED IN PART AND DENIED IN PART for
the reasons set forth in the Court’s Order dated September 27, 2017; and it is,
DECLARED that on six occasions in 2016, MACCCA failed to provide at least 48 hours
or 2 business days’ notice (whichever is greater) of the date, time, location and planned agenda
of MACCCA meetings, constituting six violations of D.C. Official Code § 2-576; and it is
DECLARED that MACCCA did not make audio recordings of five separate MACCCA
meetings in 2016, although it was feasible to do so, constituting five violations of D.C. Official
Code § 2-578(a); and it is
DECLARED that by failing to make the foregoing statutorily-required recordings of five
MACCCA meetings in 2016, MACCCA also failed to make those audio recordings available for
public inspection, constituting five violations of D.C. Official Code § 2-578(b)(2); and it is
ORDERED that in order to facilitate oversight and enforcement of this Order, pursuant
to D.C. Official Code § 2-579(d), MACCCA shall provide as an additional form of notice, at
least one week’s notice to OOG of the date, time, location, and draft agenda of any meeting of
MACCCA occurring within twelve months of the date of this Order and shall also publish on the
District’s central meeting calendar; and it is
FURTHER ORDERED that judgment is hereby entered according to the terms of the
Order.
