OMA Advice Regarding DC PCSB Meeting and OMA Requirements

On  June 14, 2024, Director Allen issued informal guidance to an inquiry as to whether a meeting of the DC Public Charter School Board, where the Members of a public body, likely meeting in person, provided the public a link to observe the meeting, and not the physical location of the meeting. D.C. Official Code § 2-575(a)(4) requires that "[t]he public body takes steps reasonably calculated to allow the public to view or hear the meeting while the meeting is taking place, or, if doing so is not technologically feasible, as soon thereafter as reasonably practicable." Director Allen found that the conduct of the meeting via a virtual platform satisfied this criterion.
